When doesn’t double jeopardy — when you can’t be tried for the same crime twice — apply? After watching this episode of The Good Wife, I learned the answer: When Cary is out for vengeance.

And vengeance was what this episode was all about.

The episode starts with Will and Alicia defending a man accused of killing his wife. And they win, which isn’t good news for Cary who was the lead on the prosecution. It seems Cary was offered a plea bargain for eight years in prison and didn’t take it. Doesn’t make him look too good for his new boss!

So he turns to a lawyer friend of his, who just happens to be in the military, like the defendant. Turns out the military court can really try someone for the same crime if they were in the military at the time of the killing. Uh oh. And the military court is extremely different. The judge rules with a much firmer hand and they even have the trial at night.

Not good for Will’s new romance (did you catch the look on Alicia’s face when she calls in the middle of the night and hears a female voice in the background?) .

Speaking of sparring sexes, the new PI, Blake, and Kalinda go at it again. Blake helps out Alicia, pointing out that Cary has made notes on the file, which leads to some new evidence. But the judge doesn’t allow it. Then in swoops Kalinda, who finds really good info that does make a difference — in fact, she finds the real killer. I say game-set-match to Kalinda. (Man, I wish she were my best friend! Characters don’t get much cooler.)

On the Peter front, an interview turns out to be a trap, but Eli catches it before it goes too far. That Childs isn’t playing nice — he’s got a sexy You Tube video that paints Peter as a womanizer. (Oh wait, Peter IS a womanizer.) But then Eli spots Becca, Zach’s conniving little girlfriend, volunteering at Peter’s campaign center and tosses her out.

Which leads Zach to suddenly reconnect with this witch (I’m being nice here) and start down a bad, bad, bad road. As Eli said it, he’s off his game this week. Vengeance, thy name is Becca. And Childs. But not Cary.

In the office, Will promises to back Diane with his votes against new partner Derrick Bond — and drops the ball at the first opportunity. The episode ends just as Kalinda has perhaps found a past link between the two and is set to tell Diane. A tasty cliffhanger if ever there were one.
